A proposed class proceeding has been filed against the group of companies that own and operate, among others, the following Long-term care and retirement homes (together the "Homes"):

The proposed class action has been brought on behalf of:

  1. All individuals living in the Homes from January 10, 2020 to the end of the COVID-19 Pandemic (the "Pandemic Period");
  2. The Estates of all individuals who died while living in the Homes during the Pandemic Period; and
  3. The family members of all such individuals referred to in (1) and (2) (together the "Class Members" or the "Class").

The action alleges that the Defendants:

  1. failed to follow acceptable practices regarding the prevention and containment of contagious respiratory illnesses such as COVID-19;
  2. failed to properly and adequately plan for and respond to the COVID-19 pandemic;
  3. failed to have adequate staff within the Homes to care for the residents in a safe and competent manner;
  4. failed to communicate adequately with families of residents living in the Homes;
  5. failed to comply with public health guidelines and directives regarding: (i) outbreak planning; (ii) supply, use, and access to personal protective equipment for staff, visitors to the Homes and residents; (iii) resident isolation and testing; (v) employee testing and screening; and
  6. breached their contractual obligations to provide adequate and appropriate care in the circumstances.

Anson Place Care Centre, Cooksville Care Centre, Earls Court Village, Eatonville Care Centre, Hawthorne Place Care Centre, Vermont Square (the "Homes"), are the retirement/long-term care facilities named as defendants in the Statement of Claim that has been issued.

  1. All individuals living in the Homes for some period of time between January 10, 2020 and the end of the COVID-19 Pandemic (the "Pandemic Period");
  2. The Estates of all individuals who died while living in the Homes during the Pandemic Period; and
  3. The family members of all such individuals referred to in (1) and (2) (together the "Class Members" or the "Class").

No. The action has not yet been certified by the Court. If it is certified, a person who fits within the court's definition of the class is automatically included in the class action unless he or she follows the court’s instructions on how to be excluded.

No. Any fees paid for representing the class are determined by the Court and no individual class member is responsible for paying counsel.
