Prior to founding Tyr LLP in June 2019, he was a senior partner at Davies Ward Phillips & Vineberg LLP in the Litigation Group where he practiced for over twenty five years.
Jim is an experienced litigator handling complex commercial disputes. He excels at identifying the critical business issues in clients’ litigation. His areas of expertise include shareholder and oppression remedy actions, class actions, securities disputes, insolvency, gaming and competition matters. He has appeared as counsel before all levels of court in Ontario, the Supreme Court of Canada and a variety of other courts and administrative tribunals across the country.

American International Group Inc.
Represented a subsidiary of American International Group Inc. in successfully defending a court application brought by The Walt Disney Company regarding the arbitration of a substantial insurance coverage dispute.
Represented two former officers of Katanga Mining in connection with enforcement proceedings brought before the Ontario Securities Commission which resulted in a complex and comprehensive settlement agreement approved by the Commission in December 2018.
General Motors of Canada Company
Represented General Motors of Canada in defending claims asserted against it in the Ontario Superior Court of Justice for approximately $250 million by approximately 20 Buick GMC dealers who were retained by GMCL following the restructuring of the company in 2009. The claims asserted were resolved consensually on the eve of trial.
Represented Crystallex International in proceedings before the Ontario Superior Court of Justice to recognize and enforce a US$1.2 billion arbitration award against Venezuela following its nationalization of one of the largest undeveloped gold deposits in the world, the Las Cristinas gold deposits located in southeastern Venezuela.
Agnico Eagle Mines Limited
Represented Agnico Eagle Mines Limited and certain of its current and former officers and directors in their defence of a multi-jurisdictional class action alleging that the company's public disclosure was false and misleading.
Ontario Lottery and Gaming Corporation (OLG)
Represented the Ontario Lottery and Gaming Corporation in connection with a $3.5 billion class action and numerous individual actions alleging OLG owed a duty of care to prevent "problem gamblers" from gambling in OLG's commercial casinos. Successfully defeated certification at hearings before the Superior Court of Justice, Divisional Court and Court of Appeal for Ontario.
EMEA Nortel Debtors
Represented the EMEA Nortel Debtors at the Ontario Commercial List and Delaware Court of Bankruptcy concerning allocation of approximately $7.5 billion of proceeds from the sale of Nortel assets. The Nortel allocation proceedings were unique in their size, complexity, and multi-jurisdictional nature.
MHR Fund Management
Represented MHR Fund Management, a significant shareholder of Lions Gate Entertainment Corp., in the unsolicited takeover bid made by Carl Icahn for Lions Gate and in the successful defence of oppression proceedings commenced by Icahn in British Columbia against MHR and Lions Gate.
MI Developments, Inc. (MID)
Represented MI Developments, Inc. in its successful defence of applications made by minority shareholders of MID to the Ontario Securities Commission by seeking orders denying MID the use of various securities law exemptions and requiring MID to obtain minority shareholder approval before proceeding with proposed related party transactions with Magna Entertainment Corp.
Acted for Eugene Melnyk, the founder of Biovail and owner of the Ottawa Senators, in defending enforcement proceedings before the Ontario Securities Commission arising from an "earnings warning" issued by Biovail in 2003. This case resulted in a lengthy trial before the OSC, following which many of the allegations made against Mr. Melnyk were dismissed.
