Pinta Maguire speaking at annual Medico-Legal Society Conference
The head of Tyr's Medical Malpractice Group, Pinta Maguire, will be speaking at the Annual Medico-Legal Society Spring event on March 9, 2022. She will be discussing the recent decision in Kamateros v. Women’s College Hospital on pleading allegations of a physician's prior negligence. The Medico-Legal Society of Toronto is an organization formed by a group of doctors and lawyers to promote medical, legal and scientific knowledge, cooperation and understanding between the professions in the best interests of patients, clients and justice. Good luck to participants of the Walker Health Law Moot
Pinta Maguire, head of Tyr's Medical Malpractice Group, will be judging the Walker Health Law Moot this weekend. The Walker Health Law Moot was created by Matthew Walker in 2020 and operates as a not-for profit law competition, whereby law students compete against each other in a virtual court forum on Zoom, representing either plaintiff or defendant in a complex medical case. Judges consist of prominent legal and medical professionals around the globe. Good luck to all the participants!

Tyr LLP is growing
Tyr is thrilled to welcome partner Jason Wadden and associate Theo Milosevic to the firm.
In addition to continuing his broad-based business law litigation practice, Jason will head up Tyr's Insolvency and Restructuring Litigation Practice. Prior to joining Tyr, Jason was a senior litigation partner at Goodmans LLP. His practice covers all areas of complex business law litigation including restructuring related litigation, corporate stakeholder disputes, regulatory matters, fraud investigations and recovery, foreign corruption and economic sanctions. An accomplished litigator known for his sound legal and business judgement, Jason regularly provides governance and strategic advice to boards and senior management on a broad range of governance and business issues.
Theo joins Tyr from the Litigation and Dispute Resolution group at Blake, Cassels & Graydon LLP where he gained experience in class actions, securities litigation, regulatory and administrative proceedings and a wide variety of contractual and commercial disputes. Theo brings an efficient and driven approach to high stakes litigation and arbitration. Prior to law school, Theo worked for a boutique corporate advisory firm based in New York City.

Artistic Swimming Class Action Update
Since filing the proposed class action less than a week ago, over 30 National level athletes have contacted counsel to be part of the proposed class. This number includes current members of the National Team. This response is significant and confirms that our clients’ experiences were not isolated. Our clients are looking for CAS to demonstrate that it is prepared to make the changes in its administration and coaching that are necessary to protect its athletes.

Tyr advancing class action pro bono on behalf of Canadian artistic swimmers
Tyr LLP is honoured to be representing a group of elite artistic swimmers in a proposed class action against Canada Artistic Swimming, filed today in the Quebec Superior Court. The action alleges that members of Canada's national artistic swimming team were subjected to various forms of psychological abuse, neglect, and harassment, including sexual and racial harassment, by coaches and staff employed by Canada Artistic Swimming, the national governing body for the sport in Canada.
These strong and courageous women advance this case in an effort to stamp out the psychological abuse and harassment that persists in elite sport in Canada. Doing so is critical not only to protect the health and well-being of our athletes, but also to enable them to reach ever higher levels of athletic achievement.
This proposed class action is being advanced jointly on behalf of the plaintiffs by Tyr and Davies Ward Phillips and Vineberg LLP on a pro bono basis.

Tyr continues to assist Caster Semenya in ECtHR
Tyr LLP is honoured to continue to assist two-time Olympic Champion Caster Semenya in her quest for equality and justice in international athletics, which is now before the European Court of Human Rights (ECtHR). Tyr partners Jim Bunting and Carlos Sayao form part of Ms. Semenya's international team of legal advisors, working alongside Schona Jolly QC, Claire McCann, Greg Nott, and Patrick Bracher. The ECtHR will be asked to consider complex and pressing issues around discrimination, the right to physical integrity, fairness, and access to justice in international sport.

Carlos Sayao speaks about human rights in sport
Tyr partner Carlos Sayao joined Allison Sandmeyer-Graves, President of Canadian Women & Sport, in a panel discussion hosted by Egale Canada and Olympic Gold Medallist, Mark Tewksbury OC, on human rights regulations in international sport. The session focused on two landmark cases brought by Olympic athletes, Caster Semenya and Dutee Chand, challenging international sporting regulations restricting the eligibility of women athletes with elevated natural testosterone levels to compete in track and field. Tyr partners Jim Bunting and Carlos Sayao represented Ms. Semenya and Ms. Chand in their respective cases before the Court of Arbitration for Sport.

Pinta has years of experience representing plaintiffs injured through obstetrical negligence, surgical negligence, hospital negligence, delayed diagnosis and catastrophic brain injuries arising from medical negligence. Adam Soliman joins Tyr
Adam joins Tyr LLP after articling at a leading full-service firm in Ottawa where he developed a diverse trial practice on matters including commercial disputes, class actions, intellectual property, entertainment and privacy law. Adam has been a lead researcher with Samuelson-Glushko Centre for Internet Policy and Public Interest Clinic and assisted counsel with oral and written submissions for interventions at the Supreme Court of Canada.
Adam will work alongside his colleagues at Tyr, adding to the firm's depth of experience in trial advocacy.

Michael O’Brien joins Tyr
Tyr LLP is excited to welcome Michael O'Brien to its growing litigation team. Michael joins Tyr after seven years with McCarthy Tétrault LLP, where he carried on a diverse trial practice focused on complex matters.
Michael has been lead counsel in trials, hearings and appeals before various courts and administrative tribunals in Ontario and is a trusted advisor to publicly traded and privately held companies, public institutions, investors, professionals and high-profile individuals.
Michael is the Vice-Chair of the American Bar Association’s Business Law Section subcommittee on Class Actions, and is an editor and regular contributor to the Class Actions chapter in the ABA’s annually updated Recent Developments in Business and Corporate Litigation. He is active in the community and has held a number of leadership positions on the Boards of charitable organizations.
Michael will work closely with his colleagues at Tyr to continue to achieve success for his clients inside the courtroom and out.

Carlos Sayao joins Tyr
Tyr LLP is delighted to announce that Carlos Sayao has joined the firm as a partner. Carlos was previously a litigation associate at Davies, Ward, Phillips & Vineberg LLP, where he developed a broad commercial and class actions litigation practice. Carlos has appeared before the Ontario Superior Court of Justice and Ontario Court of Appeal, as well as numerous arbitral and administrative tribunals.
A former competitive swimmer who represented Canada at the World Championships and Commonwealth Games, Carlos has extensive experience in sport governance and dispute resolution. He has appeared before the Court of Arbitration for Sport on multiple occasions on behalf of both athletes and sports organizations. Carlos is a Director of Swim Ontario, the provincial governing body for the sport of swimming.
In his new role at Tyr, Carlos will add to the firm’s depth of experience in commercial and civil litigation and will be a key member of the firm’s sports litigation practice alongside founding partner, Jim Bunting.

Anisah Hassan joins Tyr
Tyr LLP is thrilled to welcome Anisah Hassan to its litigation team. Anisah was previously a litigation associate at Davies Ward Phillips & Vineberg LLP and Necpal Litigation where she carried on a diverse litigation practice.
Combining her background in physics with court room experience, Anisah brings a practical approach to her cases – often involving highly technical engineering and technology matters – and to the practice of law – including acting in the first all-electronic trial on the Commercial List.
Anisah is a valuable addition to Tyr and enhances the firm’s existing skill set, especially in the area of technology related litigation.

Tyr LLP is founded
Jim Bunting, Sean Campbell and Jim Doris have announced that they are leaving Davies, Ward, Phillips & Vineberg LLP to found a new litigation firm, Tyr LLP. The three former Davies partners have over 55 years of experience litigating at one of Canada’s top litigation firms.
Although it is bittersweet to leave friends and colleagues at Davies, the three partners are enthusiastic about their new venture. The name of the firm, Tyr (pronounced like the word “tier”), is derived from an ancient Norse war god, who was responsible for upholding law and justice. Tyr was known for his bravery and by legend sacrificed one of his arms to uphold the law and protect his people. The decision to name the firm Tyr, rather than using the names of the firm’s founding parties, reflects the firm’s collaborative and team oriented approach, as well as the firm’s desire to grow from the strong foundation provided by its founding partners.
